Each piece is unique, and the images displayed on the website are for representation purposes. There may be slight variations in color, texture, or detail from the digital image to the physical painting due to monitor settings, lighting, and the inherent nature of a handmade object.

1.2. Artistic License: The artist retains all creative and artistic license in the creation of the artwork. Descriptions, titles, and interpretations are provided by the artist and are subjective.

2. Orders and Purchasing Process

2.1. Order Acceptance: Your order constitutes an offer to purchase a painting. We reserve the right to accept or decline your order for any reason at our sole discretion. All orders are subject to availability.

2.2. Pricing & Acquisition Process:

2.2.1. Personalized Pricing: Given the unique nature of each artwork, we operate on an inquiry-based acquisition model. To learn the price and discuss availability, please contact us to express your interest in a specific piece.

2.2.2. Price Quotation & Validity: Upon receiving your inquiry, we will provide a detailed email including the price, shipping estimates, and any other relevant details. The quoted price is guaranteed for 14 days from the date of the quotation email.

2.2.3. Securing Your Artwork: To secure the painting at the quoted price, you must notify us of your intent to purchase and complete the checkout process, which we will facilitate via a private payment link or invoice. All sales are final, as outlined in our Return Policy.

2.2.4. Order Confirmation: Your purchase is not confirmed until you receive an order confirmation email from us. We reserve the right to decline any order at our sole discretion.

2.3. Sales Tax: Sales tax will be added to the purchase price where required by law.

2.4. Payment: Payment is processed securely through our third-party payment processors. You agree to provide current, complete, and accurate purchase and account information for all purchases.

3. Shipping and Delivery

3.1. Processing Time: As each piece requires careful preparation for shipping, please allow us 7 business days for your order to be processed and shipped. You will receive a shipping confirmation email with tracking information once your order has shipped.

3.2. Shipping Costs: Shipping costs are calculated at checkout and are the responsibility of the customer, unless otherwise stated in a promotion.

3.3. Delivery: We are not responsible for any delays in delivery caused by the shipping carrier, customs, weather, or other events beyond our reasonable control.

3.4. International Orders: International customers are responsible for any and all customs duties, import taxes, and brokerage fees levied by the destination country. We have no control over these charges and cannot predict what they may be.

4. Intellectual Property

4.1. Copyright of Artwork: The artist, Jaya Vig retains the full copyright and all intellectual property rights to all paintings sold through the Service. This includes the right to reproduce the artwork, create derivative works, and display the artwork for promotional purposes.

4.2. Customer's Rights: Upon purchase, the customer acquires the physical painting itself, but not the copyright. The customer may not reproduce, print, or create commercial merchandise featuring the artwork without the express written permission of the artist.

4.3. Website Content: All content on the Service , including text, graphics, logos, images, and software, is the property of Viktamna Holdings or its content suppliers and is protected by international copyright laws.

5. User Accounts

5.1. Account Security: If you create an account on our Service, you are responsible for maintaining the security of your account and password. You agree to accept responsibility for all activities that occur under your account.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Viktamna Holdings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the website, or from any paintings purchased through the website.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Maharashtra/India, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

 1. Final Sale - No Returns for Change of Mind or Discrepancy in Expectation

Due to the unique, one-of-a-kind, and hand-painted nature of our products, all sales are final. We do not accept returns, cancellations, or offer refunds or exchanges for the following reasons:

· Change of mind.

· Subjective dissatisfaction with the artwork's aesthetic.

· Minor variations in color, texture, or detail between the digital image on the website and the physical painting.

 You acknowledge and agree that such variations are inevitable due to factors including, but not limited to, your monitor's display settings, lighting conditions, and the inherent characteristics of a handmade original artwork. By purchasing, you accept these inherent qualities as part of the artwork's unique value.

2. Damaged in Shipment

In the rare event your painting arrives damaged, you must contact us within 48 hours of delivery. You will be required to provide clear photographs and/or a video of the damaged painting, all aspects of the packaging, and the shipping label. We will investigate the claim and work with you to file a claim with the shipping carrier. Depending on the circumstances and the extent of the damage, our sole obligations will be to arrange for a repair (if feasible and agreed upon), a replacement (if a suitable one-of-a-kind piece is available), or a refund.

3. Incorrect Item Received

If you receive an incorrect item (i.e., a different painting than the one you ordered), please contact us within 7 days of delivery. We will arrange for the return of the incorrect item at our expense and, upon its receipt in its original condition, ship the correct painting to you. If the correct painting is no longer available, we will issue a full refund.

Due to the fragile and unique nature of our artwork, we handle shipping on a case-by-case basis. All shipping details, including methods, timelines, and charges, will be discussed and finalized after you express interest in a specific painting.

Upon your inquiry, we will provide a detailed email that includes:

· A personalized shipping quote for your location.

· Available shipping methods (e.g., standard, expedited, white-glove).

· An estimated packaging and dispatch timeline.

· Insurance and tracking information.

Your order will only be shipped once the shipping method has been agreed upon and payment has been confirmed in full.

· Processing: Please allow 5-10 business days for us to carefully package your painting for its journey before it is dispatched.

· Charges: Shipping charges for destinations within [Your Country] will be provided in your detailed quotation email. These charges cover professional packaging materials, labor, and the carrier costs.

· Transit: Once dispatched, you will receive a tracking number. We are not liable for delays caused by the shipping carrier once the package is in their possession.

3. International Shipping

· Processing: Please allow 7-14 business days for packaging and customs documentation preparation before dispatch.

· Charges: Shipping charges for international destinations will be provided in your detailed quotation email. This quote will include all costs for packaging, insurance, and carrier fees to your destination.

· Customs, Duties, and Taxes: You, the customer, are solely responsible for any and all customs duties, import taxes, VAT, and brokerage fees levied by your country upon import. These charges are not included in our shipping quote and are beyond our control or prediction. Payment of these amounts is necessary to release your package from customs and is your responsibility.

4. Delivery

· Signature: We strongly recommend requiring a signature upon delivery for all shipments. We cannot be held responsible for packages left unattended after delivery is confirmed by the carrier.

· Delays: We are not responsible for delivery delays resulting from customs inspections, weather, carrier errors, or other events beyond our reasonable control.

· Inspection: Please inspect your painting immediately upon delivery. Any issues related to damage in transit must be reported to us within 48 hours, as per our Damages policy

· The appearance, perceived value, or subjective quality of any painting.

· Any damage to a painting after it has been delivered to the shipping carrier and a tracking number has been provided to you.

· Any decisions made or action taken in reliance on the materials or paintings provided through the Service.
